This agreement is between Foci Education (Foci), located in Sydney, Australia, and the individual applying for the Free Trial Lesson Promotion (the "Promotion"). By applying for or receiving any benefits under this Promotion, you agree to the following terms and conditions.
1. Eligibility
This Promotion is only available to new students who have never enrolled or attended a lesson at Foci Education.
If you are a current or former student, you are not eligible for this Promotion. Please contact our team for more details.
2. School Enrolment Requirement
The trial lesson can only be applied to a subject or course that you are currently studying at school.
Foci Education may require proof of enrolment, such as a school timetable or class schedule, to confirm eligibility.
3. Application Process
All applicants must submit a completed Expression of Interest (EOI) form, either online or in person, with all required information (e.g., student and parent names, email address, and contact number).
Once your application is reviewed and found eligible, you will be placed on the Free Trial Lesson Waitlist.
We aim to respond to applications within 48 hours. However, Foci Education reserves the right to decline applications at its discretion without providing specific reasons.
4. Timeline and Availability
Free trial lessons are offered during weeks 1-10 of regular school terms, subject to tutor availability.
During holiday programs, free trial lessons are limited to tutor availbility.
Our team will contact you to confirm your placement and discuss your available options.
5. Attendance Policy
Attendance is mandatory once a free trial lesson is confirmed.
Students must notify us at least 2 hours in advance if they are unable to attend.
If a lesson is missed without adequate notice, or if a cancellation is made within 24 hours of the lesson time, the application will lapse, and reapplication for this Promotion will not be permitted.
Lessons will only be credited if the student’s absence is due to illness, with appropriate notification.
6. Enrolment Appointment
An enrolment appointment must be completed in person with a Foci Education principal 15 minutes prior to the scheduled trial lesson.
Failure to attend the enrolment appointment on time may result in the cancellation of the trial lesson without notice.
7. Cancellation by Foci Education
Foci Education reserves the right to cancel scheduled trial lessons at its discretion. In such cases, we will make every effort to offer an alternative option.
8. Non-Transferability
Trial lesson placements are non-transferable between students or courses.
9. No Combination with Other Promotions
The Promotion cannot be combined with any other offers or promotions.
10. Additional Fees and Services
Trial lessons are limited to face-to-face sessions. Any additional services provided will be at the discretion of Foci Education staff.
11. General Terms
By applying for the Free Trial Lesson, you also agree to adhere to Foci Education’s general Terms and Conditions, available on our website.

3. Use of AI Chatbot (Chatbase)
Our website includes a chatbot feature powered by Chatbase. When you interact with our chatbot, it collects:

Chat logs for internal training and support purposes, aimed at improving the chatbot's accuracy and our customer service responses.
By interacting with our chatbot, you acknowledge and agree to the collection and processing of your messages and any personal information you choose to provide for the purposes of responding to your inquiry and improving our chatbot's functionality. A clear notice regarding data collection is displayed at the start of your chat session. You may choose to opt out by not interacting with the chatbot. Chat logs are generally retained for a period of up to 12 months for service improvement.

(Currently, Foci Education does not engage in such activities).

8. Children's Privacy
Foci Education provides educational services that may be used by children. We are committed to protecting the privacy of children.
If our services are used by children under the age of 16 (or the relevant age of digital consent in your jurisdiction), we require verifiable parental or guardian consent for the collection and processing of their personal data, especially for data that is not strictly necessary for the provision of the educational service itself.
We do not knowingly collect personal information from children under 13 without parental consent. If we become aware that we have inadvertently received personal information from a child under 13 without verifiable parental consent, we will delete such information from our records.
Parents or guardians have the right to review, request deletion of, or refuse further collection or use of their child's personal information. Please contact us using the details in Section 11 to exercise these rights.
9. Data Breach Notification
We take the security of your personal data seriously. In the unlikely event of a data breach that is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant supervisory authority (e.g., the OAIC in Australia, or your local DPA in the EU/UK) without undue delay, and where feasible, not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to your rights and freedoms. This document outlines the terms and conditions that govern the relationship between Foci Education and its clients and customers. By engaging with Foci Education's services, clients and customers agree to adhere to the following terms.
1. Enrolment Policies
1.1 Enrolment Requirements
Completion of enrolment at Foci Education necessitates the submission of the following documents (dated no more than six months prior) via email to info@focieducation.com or by responding to the initial enrolment correspondence:

1.2 Deposits and Enrolment Cancellations
Foci Education endeavors to render the enrolment process as efficient as possible. The following policies pertain to deposits and cancellations:
1.2.1 General Discontinuation Policy
Foci Education provides the option of complimentary cancellation and a complete refund for any unused lessons should your child wish to discontinue during the term.
1.2.2 Booking Cancellation Policy
Within 24 hours of booking: Cancellations initiated within 24 hours of booking are eligible for a full refund, encompassing the booking deposit.
After 24 hours of booking: Subsequent to the 24-hour period following booking, deposits become non-refundable and non-transferable. Any supplementary payments, exclusive of the deposit, shall be transferable to a subsequent booking.
1.2.3 For Private Enrolments
It is important to note that enrolment is conditional and unconfirmed until payment is cleared; consequently, the allocated timeslot remains subject to modification.
Securing the preferred day and time necessitates full payment. This payment shall be credited against the final invoice preceding the student's initial lesson.
1.2.4 For Group Enrolments
The designated day and time for the prospective group class remains provisional until full payment is rendered to confirm enrolment.
Any proposed modifications to the schedule, intended to accommodate client requirements, are contingent upon availability and are not guaranteed until the receipt of full payment.
Should Foci Education be unable to modify a class schedule to align with the client's availability prior to the commencement of the initial lesson, a complete refund will be issued for any lessons not utilised or taken.
1.2.5 For Annual Payment Clients
New annual enrolments mandate upfront payment for the full year. Lessons missed during the current term shall be retained as a transferable credit note applicable to the subsequent term.
Should a client opt not to continue into the subsequent term, the credit note pertaining to the initial term (or within 90 days) shall be refunded via bank transfer.
Lessons not utilised or taken subsequent to the initial 90-day period from the first lesson are non-refundable under the terms of the annual payment contract, unless explicit approval for credit is granted by the respective principals.
1.2.6 For Group Rescheduling Requests
Clients desiring to join an existing group class who are unable to attend the designated timeslot may submit a formal request for the exploration of rescheduling options to accommodate their availability.
A non-refundable deposit of $100 is requisite for the processing of this request. This sum shall only be refunded in the event that Foci Education is unable to successfully modify the existing class schedule to align with the client's requirements. Upon successful rescheduling, the deposit will be credited against the client's initial invoice.
1.2.7 Payment Due Date and Allocation Confirmation
All outstanding payments must be cleared in full prior to attending the first lesson. Class placement is confirmed solely upon receipt of full payment. Quotes and class allocations are subject to change if payment has not been received within seven (7) days of the invoice date.
2. Operational Policies
2.1 Missed Lessons
2.1.1 Attendance Policy
Notice of Absence: Students are mandated to provide a minimum of 3 hours' notice in the event of an inability to attend a scheduled lesson.
Commitment to Attendance: Students are expected to exert all reasonable efforts to attend all scheduled lessons.
Credit for Absences: Lesson credit shall only be issued if the student's absence is attributable to a verified illness, substantiated by a medical certificate, a doctor's note within 7 days of missed lesson.
Focus Lessons: Complimentary focus lessons are extended solely at the discretion of Foci Education and are contingent upon availability.
2.2 Assessment Policy
Notification of Assessments: Students are required to provide reasonable notification upon receipt of assessment task notifications from their educational institution.
Original Work Requirement: Foci Education personnel are prohibited from authoring assessment tasks on behalf of students under any circumstances.
Submission Deadline for Edits: Edits or reviews pertaining to assessment tasks will not be accepted within 48 hours of the stipulated due date.
Draft Limits: A maximum of three (3) drafts per assessment task may be submitted by students.
Draft Submission Protocol: All draft submissions are required to adhere to the email template supplied by the assigned tutor. Drafts submitted in deviation from this template will not undergo review.
Turnaround for Feedback: A minimum turnaround time of two (2) business days is required for the provision of marked drafts or feedback on student work.
2.3 Fees and Payment Policy
Service Coverage: Fees encompass face-to-face lessons. The provision of any supplementary services is at the sole discretion of Foci Education staff.
2.3.1 Make-Up Lessons:
Lessons missed during a term may be rescheduled for make-up, contingent upon availability.
A maximum of two (2) make-up lessons per student is permissible.
2.3.2 GST Policy:
Clients enrolled prior to June 29, 2022, shall receive complimentary Goods and Services Tax (GST) on fees, at the discretion of Foci Education.
Clients who fail to remit their fees by the due date stated on the invoice may forfeit the complimentary GST, resulting in the subsequent charge of the full GST amount.
2.3.3 Payment Methods and Records
All fee-related payments must be remitted to the bank account listed in your invoice. Your online transaction record serves as your official receipt. For any payment or enrolment-related inquiries, new customers are required to contact our staff prior to visiting the centre.
2.4 In-Class and Conduct Policy
Homework Compliance: Students are obligated to complete assigned homework on a weekly basis. Persistent failure to submit homework may lead to parental notification and, if the issue remains unresolved, potential suspension or expulsion from the centre.
Behaviour Expectations: All students are required to conduct themselves in a safe, respectful, and appropriate manner during their attendance at the centre and during online interactions with staff or other students. Inappropriate conduct shall not be tolerated and may result in disciplinary action.
Student Safety: To ensure the safety and facilitate the academic progression of students, bi-annual school reports must be submitted to Foci Education for review.
Courtesy and Politeness: The utilisation of polite expressions, such as "please" and "thank you," is encouraged and highly valued.
3. General Provisions
3.1 Photography and Videography Consent
Foci Education may, from time to time, capture photographs or video recordings of students during lessons or events for promotional, educational, or internal training purposes. These materials may be utilised on our website, social media channels, marketing collateral, or in educational resources. By enrolling a student with Foci Education, parents/guardians grant consent for their child's image or likeness to be captured and used for these purposes, unless explicit written objection is provided to Foci Education prior to the commencement of services. Should a parent/guardian wish to withdraw consent, they must notify Foci Education in writing, and reasonable efforts will be made to cease future use of new materials. Existing materials may remain in circulation.
3.2 Emergency Procedures and Medical Information
To ensure the safety and well-being of all students, Foci Education requires parents/guardians to provide comprehensive and up-to-date medical information, including any allergies, chronic conditions, or specific medical needs, prior to the commencement of services. In the event of a medical emergency, Foci Education personnel will administer necessary first aid and, if deemed appropriate or required, contact emergency services. Parents/guardians grant consent for Foci Education staff to seek emergency medical attention for their child if they are unable to be reached. Foci Education will endeavor to contact the primary and emergency contacts provided by the parent/guardian as soon as practicably possible.
3.3 Complaints and Feedback Procedure
Foci Education is committed to providing high-quality educational services and values feedback from its clients. Should a client have a complaint or wish to provide feedback regarding any aspect of our services, they are encouraged to submit their concerns in writing to info@focieducation.com. All complaints will be acknowledged within two (2) business days, and Foci Education will endeavor to investigate and resolve the matter promptly and fairly, typically within ten (10) business days. Clients will be kept informed of the progress of their complaint throughout the resolution process.
3.4 Disclaimer Regarding Academic Outcomes
Foci Education provides supplementary educational support and guidance designed to enhance student learning and academic performance. While our dedicated staff strive to deliver high-quality instruction and support, Foci Education does not guarantee specific academic results, grades, or admission to particular educational institutions. Student success is contingent upon various factors, including individual effort, consistent attendance, and engagement with the learning process.
3.5 Force Majeure Clause
Foci Education shall not be deemed in breach of these terms or liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government regulations, epidemics, pandemics, natural disasters, strikes, or failures of public utilities or transportation. In such events, Foci Education will make reasonable efforts to continue services where feasible or to provide alternative arrangements, such as online instruction, if appropriate. Should services be suspended for an extended period due to a force majeure event, Foci Education will communicate with clients regarding potential credit or refund arrangements, as deemed appropriate by the circumstances.
3.6 Acknowledgement of Terms
By completing the enrolment process, making payment for services, or by permitting a student to attend lessons with Foci Education, clients and their associated students acknowledge that they have read, understood, and agree to be bound by all the terms and conditions set forth in this Foci Education Terms of Service document. This agreement constitutes the entire understanding between Foci Education and the client regarding the provision of services.

Terms & Conditions
These terms and conditions govern the provision of the "WriteBack" service, a one-time, high-quality written feedback service offered by Foci Education. By purchasing and utilising this service, the customer agrees to adhere to the following conditions.
1. Scope of Service
The WriteBack service is exclusively dedicated to the marking and provision of expert feedback on written English responses.
1.1 Eligible Submissions
Eligible responses encompass essays, creative writing, short responses, and analytical pieces within the broader subject of English. This includes work for curricula such as NSW HSC, IB English, and international equivalents, provided the content falls within the realm of English Literature or Literacy.
1.2 Student Eligibility
This service is available only to students in Year 7 through Year 12, with the explicit exclusion of Year 12 English Extension 2 students.
1.3 Service Inclusions
Each submission will be returned within 2–3 business days and includes:
In-depth written feedback and inline annotations.
A PDF, Microsoft Word (.doc/.docx), and Apple Pages (.pages) version of the marked work.
Verbal audio feedback with live transcription, optimised for Apple Notes compatibility.
Academic suggestions and recommended readings designed to enhance writing proficiency.
2. Submission Guidelines
2.1 Required Format
Students must submit their work in Microsoft Word (.doc/.docx) or Apple Pages (.pages) format. Submissions via Google Docs are also accepted, provided they can be downloaded or accessed in a compatible format.
2.2 Submission Method
Work must be emailed directly to info@focieducation.com or uploaded via the official website submission portal (if and when available).
2.3 Word Limit
Each submission is strictly limited to a maximum of 1,100 words.
2.4 Submission Responsibility
It is the sole responsibility of the student to ensure that the submitted file is complete, finalised, and transmitted correctly. Incomplete, corrupted, or inappropriate submissions will nonetheless be considered as fulfilled services and will not be eligible for re-submission or refund under the same transaction.
3. Service Delivery
3.1 Turnaround Time
Foci Education guarantees a turnaround time of two (2) to three (3) business days from the confirmed date of submission. Business days are defined as Monday through Friday. Submissions received on weekends or public holidays will be deemed as received on the next business day.
3.2 Feedback Format
Students will receive a comprehensive feedback package, which includes:
Inline comments and annotations directly on the document.
Detailed written commentary providing evaluation and insights.
The marked work provided in PDF, Microsoft Word, and Apple Pages formats.
Verbal audio feedback, accompanied by a live transcription, optimised for Apple Notes.
Recommended academic readings and actionable improvement strategies.
4. Revision and Follow-Up
4.1 Clarification Questions
Students are permitted to submit one (1) follow-up question via email in response to the feedback received.
4.2 Subsequent Revisions
Further markups, edits, or resubmissions of the same work are not included within the initial transaction. Should additional review be desired, these must be booked as separate services.
5. Fees and Payment
5.1 Pricing
The fees for the WriteBack service are structured as follows:
Years 7–10: $220 AUD
Years 11–12: $250 AUD
All fees are inclusive of Goods and Services Tax (GST) for Australian customers.
5.2 Payment Requirement
Full payment for the WriteBack service is required and must be cleared prior to Foci Education commencing the marking and feedback process. The service will only commence upon confirmation of successful payment.
5.3 Accepted Payment Methods
Foci Education accepts the following payment methods for the WriteBack service:
Credit Card (Visa, Mastercard, American Express) via Stripe.
Bank Transfer (details will be provided on the invoice).
5.4 Payment Processing
Credit card payments are processed securely through our third-party payment processor, Stripe. Customers acknowledge that by utilising a credit card for payment, they agree to Stripe's terms and conditions. A card processing fee of 1.8% will be applied to all credit card transactions and will be clearly outlined on the invoice. Foci Education is not responsible for any issues arising from errors or failures in Stripe's payment processing systems.
5.5 Invoicing
An invoice detailing the total amount due, including the WriteBack service fee and any applicable card processing fees, will be provided to the customer upon purchase of the WriteBack service.
5.6 Refunds for Service Fees
All payments for the WriteBack service are strictly non-refundable under any circumstances, except in exceptional circumstances at the sole discretion of Foci Education. For clarity, "exceptional circumstances" refers exclusively to technical errors on Foci Education’s part that entirely prevent the delivery of the WriteBack service.
5.7 Submission Window and Forfeiture
Once purchased, students must submit their work within five (5) to seven (7) business days. Foci Education will make reasonable attempts to follow up with customers who have not submitted their work within this timeframe. However, submissions received outside this designated window may be forfeited at Foci Education’s discretion without refund.

Customers are required to contact Foci Education directly via info@focieducation.com to resolve any payment-related disputes prior to initiating a chargeback with their financial institution.
6. Credit Redemption Policy ("First Mark, Full Credit" Promotion)
This section outlines the terms pertaining to the redeemable tuition credit offered as part of the "First Mark, Full Credit" promotion for new customers.
6.1 Eligibility for Credit Redemption
New customers who purchase their first WriteBack service are entitled to receive the full amount paid for that service (up to $250 AUD) back as a tuition credit. This credit is to be used exclusively for future term-based tuition services at Foci Education. The tuition credit is non-transferable and applies only to future term enrolments; it cannot be applied to the current term of study in which the WriteBack was purchased.
6.2 Credit Value and Word Limit for Promotion
For the purpose of this promotion, the WriteBack service is valued at $250 AUD and applies to a written English piece up to 1,100 words.
6.3 Timing of Credit Activation
The tuition credit becomes active and redeemable from the commencement of the full academic term immediately following the WriteBack purchase date. This ensures the credit is applied to a complete term’s tuition package and not retroactively or in partial/incomplete terms.
6.4 Restriction on Offset Against Missed Lessons
The tuition credit from the WriteBack cannot be utilised to reduce the value of invoices that contain refunded or credited missed lessons. This policy is in place to maintain fairness and the integrity of Foci Education's separate missed lesson credit/refund policy.
6.5 Credit Expiry
The tuition credit must be utilised within two (2) academic terms from the date of the WriteBack purchase. Any unused credits after this period will expire and are not eligible for refund.
6.6 No Cash Value
The tuition credit holds no cash value and cannot be redeemed for money or used outside of Foci Education’s tuition services.
6.7 One-Time Use
The tuition credit from the WriteBack is applicable once per student and only on their first purchase of the WriteBack service. Repeat purchases of the WriteBack do not qualify for additional tuition credit unless otherwise specified in writing by Foci Education.
7. Content Ownership & Usage
7.1 Student Intellectual Property
All student submissions remain the intellectual property of the student.
7.2 Foci Education's Usage Rights
Foci Education reserves the right to utilise anonymised versions of marked student work for internal marketing, educational, or training purposes. All personal identifiers will be removed to protect student privacy.
8. Parental/Guardian Consent
For students under the age of 18, the purchase and use of the WriteBack service requires the explicit consent of a parent or legal guardian.
8.1 Consent Overview
By engaging with WriteBack by Foci Education, the parent or legal guardian consents to their child (under 18 years of age) utilising our online academic feedback service. This consent extends to the nature of the service and the handling of the child’s information and academic work.
8.2 Data Collection and Use Acknowledgment
By providing consent, the parent/guardian acknowledges that:
The child’s academic work and basic personal information (such as name, year level, and contact details) will be collected and stored securely.
The child’s work will be accessed solely by authorised Foci Education staff.
Excerpts of anonymised student work may be used for internal training or marketing purposes, with all identifying details removed.

8.3 Parental Responsibility
By proceeding with payment and submission, the parent/guardian:
Confirms their status as the parent or legal guardian of the student.
Acknowledges and accepts all policies related to WriteBack, including submission guidelines, data use, pricing, and service limitations.
Grants consent for Foci Education to communicate directly with their child for the express purposes of delivering feedback related to the WriteBack service.

9. General Provisions

Foci Education reserves the right to modify these Terms & Conditions at any time. Any changes will become effective immediately upon posting the updated terms on the Foci Education website.

These terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
9.3 Entire Agreement
These Terms & Conditions, along with any referenced policies (such as the Privacy Policy and Redeemable Credit Terms & Conditions), constitute the entire agreement between Foci Education and the customer regarding the WriteBack service, superseding all prior discussions or agreements.
