Terms of service

  • This agreement is between Foci Education (Foci), located in Sydney, Australia, and the individual applying for the Free Trial Lesson Promotion (the "Promotion"). By applying for or receiving any benefits under this Promotion, you agree to the following terms and conditions.

    1. Eligibility

    • This Promotion is only available to new students who have never enrolled or attended a lesson at Foci Education.

    • If you are a current or former student, you are not eligible for this Promotion. Please contact our team for more details.

    2. School Enrolment Requirement

    • The trial lesson can only be applied to a subject or course that you are currently studying at school.

    • Foci Education may require proof of enrolment, such as a school timetable or class schedule, to confirm eligibility.

    3. Application Process

    • All applicants must submit a completed Expression of Interest (EOI) form, either online or in person, with all required information (e.g., student and parent names, email address, and contact number).

    • Once your application is reviewed and found eligible, you will be placed on the Free Trial Lesson Waitlist.

    • We aim to respond to applications within 48 hours. However, Foci Education reserves the right to decline applications at its discretion without providing specific reasons.

    4. Timeline and Availability

    • Free trial lessons are offered during weeks 1-10 of regular school terms, subject to tutor availability.

    • During holiday programs, free trial lessons are limited to tutor availbility.

    • Our team will contact you to confirm your placement and discuss your available options.

    5. Attendance Policy

    • Attendance is mandatory once a free trial lesson is confirmed.

    • Students must notify us at least 2 hours in advance if they are unable to attend.

    • If a lesson is missed without adequate notice, or if a cancellation is made within 24 hours of the lesson time, the application will lapse, and reapplication for this Promotion will not be permitted.

    • Lessons will only be credited if the student’s absence is due to illness, with appropriate notification.

    6. Enrolment Appointment

    • An enrolment appointment must be completed in person with a Foci Education principal 15 minutes prior to the scheduled trial lesson.

    • Failure to attend the enrolment appointment on time may result in the cancellation of the trial lesson without notice.

    7. Cancellation by Foci Education

    • Foci Education reserves the right to cancel scheduled trial lessons at its discretion. In such cases, we will make every effort to offer an alternative option.

    8. Non-Transferability

    • Trial lesson placements are non-transferable between students or courses.

    9. No Combination with Other Promotions

    • The Promotion cannot be combined with any other offers or promotions.

    10. Additional Fees and Services

    • Trial lessons are limited to face-to-face sessions. Any additional services provided will be at the discretion of Foci Education staff.

    11. General Terms

    • By applying for the Free Trial Lesson, you also agree to adhere to Foci Education’s general Terms and Conditions, available on our website.

  • Enrolment Requirements
    To complete your enrolment at Foci Education, please provide the following documents (dated no more than six months prior) via email to david@focieducation.com or by replying to your enrolment email thread:

    • 1x School Report (pending)

    • 1x Sample Writing Task (received)

    • 1x Interview (waived)

    Deposits and Cancellations
    We aim to make the enrolment process as seamless as possible. Below are our policies for deposits and cancellations:

    General Policy

    • We are happy to offer free cancellation and a full refund for any unused lessons should your child wish to discontinue during the term.

    For Private Enrolments

    • Please note that enrolment is conditional and unconfirmed until payment is cleared, meaning the quoted timeslot is subject to change.

    • Full payment is required to secure your chosen day/time. This amount will be applied toward your final invoice prior to your child's first lesson.

    For Group Enrolments

    • The quoted day and time for the class you’re interested in is subject to change until full payment is made to secure your spot.

    • Any proposed schedule adjustments to accommodate your needs will depend on availability and are not guaranteed until full payment is received.

    • If we are unable to adjust a class to suit your schedule before you start your first lesson, we will offer you a full refund for any unused/untaken lessons.

    For Annual Payment Clients

    • All new annual enrolments are required to pay upfront for the full year. Any missed lessons from the current term will be retained as a transferable credit note for the following term.

    • If you choose not to continue into the next term, we will refund the credit note for missed lessons from your first term (or 90 days) via bank transfer.

    • Unused/untaken lessons beyond your first 90 days from lesson 1 are non-refundable as part of the annual payment contract unless a credit is approved by the individual principals.

    Cancellation Policy

    • Within 24 hours of booking: Fully refundable, including the booking deposit.

    • After 24 hours of booking: Deposits are non-refundable and non-transferable. Any additional amount paid, apart from the deposit, will be transferable to a future booking.

  • Attendance Policy

    1. Notice of Absence: Students are required to provide at least 2 hours’ notice if they are unable to attend a scheduled lesson.

    2. Commitment to Attendance: Students are expected to make every reasonable effort to attend all booked lessons.

    3. Credit for Absences: Lessons will only be credited if the student’s absence is due to verified illness and appropriate evidence is provided.

    4. Focus Lessons: Complimentary focus lessons are provided at the sole discretion of Foci Education and are subject to availability.

    Assessment Policy

    1. Notification of Assessments: Students must provide reasonable notice upon receiving assessment task notifications from their school.

    2. Original Work Requirement: Foci Education staff will not author assessment tasks on behalf of students under any circumstances.

    3. Submission Deadline for Edits: Edits or reviews of assessment tasks will not be accepted within 48 hours of the due date.

    4. Draft Limits: Students may submit a maximum of three (3) drafts per assessment task.

    5. Draft Submission Protocol: All draft submissions must follow the email template provided by the assigned tutor. Drafts submitted outside of this template will not be reviewed.

    6. Turnaround for Feedback: A minimum of two (2) business days is required for the return of marked drafts or feedback on student work.

    Fees and Payment Policy

    1. Service Coverage: Fees cover face-to-face lessons. Any additional services provided are at the discretion of Foci Education staff.

    2. Make-Up Lessons:
      12.1. Missed lessons during a term may be made up, subject to availability.
      12.2. A maximum of two (2) make-up lessons per student applies.

    3. GST Policy:
      13.1. Customers enrolled prior to June 29, 2022 will receive complimentary GST on fees at the discretion of Foci Education.
      13.2. Customers who fail to pay their fees by the due date stated on the invoice may forfeit the complimentary GST, with the full GST amount subsequently charged.

    In-Class and Conduct Policy

    1. Homework Compliance: Students are required to complete assigned homework each week. Repeated failure to submit homework may result in parental notification and, if unresolved, suspension or expulsion from the centre.

    2. Behaviour Expectations: All students must conduct themselves in a safe, respectful, and appropriate mannerwhile attending the centre and when interacting online with staff or other students. Inappropriate conduct will not be tolerated and may result in disciplinary action.

    3. Student Safety: To ensure the safety and academic progress of students, bi-annual school reports must be submitted to Foci Education for review.

    4. Courtesy and Politeness: Use of polite expressions, such as "please" and "thank you," is encouraged and greatly appreciated.

  • 1. Acceptance of Terms

    1.1 By accessing and using the FOCI EDU website (www.focieducation.com), you agree to be bound by these Website Terms of Use ("Terms"). If you do not agree to these Terms, you must refrain from using the website.

    2. Intellectual Property

    2.1 The content on this website, including but not limited to text, graphics, logos, icons, images, and software, is the property of FOCI EDU or its licensors and is protected by Australian and international copyright laws.

  • WriteBack by FOCI EDU - Payment Terms and Conditions

    1. Payment Requirement

      1.1 Payment for the WriteBack service is required in full and must be cleared before FOCI EDU will provide the marking and feedback service.

      1.2 The WriteBack service will only commence upon confirmation of successful payment.

    2. Pricing

      2.1 The fees for the WriteBack service are as follows:

      • Years 7–10: $\$$220 AUD

      • Years 11–12: $\$$250 AUD

      2.2 All fees are inclusive of Goods and Services Tax (GST) for Australian customers.

    3. Accepted Payment Methods

      3.1 FOCI EDU accepts the following payment methods for the WriteBack service:

      • Credit Card (Visa, Mastercard, American Express) via Stripe

      • Bank Transfer (details will be provided on the invoice)

    4. Payment Processing

      4.1 Credit card payments are processed securely through our third-party payment processor, Stripe. Customers acknowledge that by using a credit card for payment, they agree to Stripe's terms and conditions.

      4.2 A card processing fee of 1.8% will be applied to all credit card transactions and will be clearly outlined on the invoice.

      4.3 FOCI EDU is not responsible for any issues arising from errors or failures in Stripe's payment processing systems.

    5. Invoicing

      5.1 An invoice will be provided to the customer upon purchase of the WriteBack service.

      5.2 The invoice will detail the total amount due, including the WriteBack service fee and any applicable card processing fees.

    6. Refunds

      6.1 As stated in our general WriteBack Terms and Conditions, all payments for the WriteBack service are non-refundable, except in exceptional circumstances at the sole discretion of FOCI EDU.

      6.2 For clarity, "exceptional circumstances" refers exclusively to technical errors on FOCI EDU’s part that entirely prevent the delivery of the WriteBack service.

    7. Payment Disputes

      7.1 Customers are required to contact FOCI EDU directly via david@focieducation.com to resolve any payment-related disputes before initiating a chargeback with their financial institution.

    8. Changes to Payment Terms

      8.1 FOCI EDU reserves the right to modify these Payment Terms and Conditions at any time. Any changes will be effective immediately upon posting1 the updated terms on the FOCI EDU website.

    1. Scope of Service

      1. This service is exclusively for the marking and feedback of written English responses.

      2. Eligible responses include essays, creative writing, short responses, and analysis pieces within the subject of English.

      3. Only students in Year 7 through Year 12 are eligible for this service (not including Year 12, Extension 2 English)

      4. We support curriculum types including NSW HSC, IB English, and overseas equivalents, provided the work falls within the realm of English Literature or Literacy.

    2. Submission Guidelines

      1. Students must submit their work via Microsoft Word (.doc/.docx), Apple Pages (.pages), or Google Docs.

      2. Work must be submitted via the submission page/portal.

      3. Each submission is limited to a maximum of 1100 words.

      4. It is the student’s responsibility to ensure the file is complete, finalised, and submitted correctly. Incomplete or inappropriate submissions will still be counted as fulfilled services and will not be eligible for resubmission or refund.

    3. Turnaround Time

      1. Foci Education guarantees a 2 to 3 business day turnaround from the date of submission.

      2. Business days are Monday to Friday. Work submitted on weekends or public holidays will be treated as received on the next business day.

    4. Feedback Format
      Students will receive a comprehensive feedback package which includes:

      1. Inline comments and annotations

      2. Written commentary with detailed evaluation

      3. A PDF, Microsoft Word, and Apple Pages version of their marked work

      4. Verbal audio feedback, with live transcription, optimised for Apple Notes

      5. Recommended academic readings and improvement strategies

    5. Revision and Follow-Up

      1. Students may submit one follow-up question via email in response to their feedback.

      2. Further markups, edits, or resubmissions will not be accepted under the same transaction. These must be booked as separate services.

    6. Fees, Refunds & Validity

      1. The fees for a WriteBack is non-refundable under any circumstances.

      2. Once purchased, students must submit their work within 5 to 7 business days.

      3. Foci Education will make reasonable attempts to follow up with customers who have not submitted their work. However, submissions outside this window may be forfeited at Foci Education’s discretion without refund.

    7. Redeemable Credit

      1. This service includes a 100% redeemable tuition credit, applicable toward future enrolment at Foci Education.

      2. Full details regarding credit usage, timing, and restrictions are outlined in our separate Redeemable Credit Terms & Conditions, which form part of this agreement and can be viewed here.

    8. Content Ownership & Usage

      1. All student submissions remain the intellectual property of the student.

      2. Foci Education reserves the right to use anonymised versions of marked work for marketing, educational, or training purposes. All personal identifiers will be removed to protect student privacy.

    9. Parental/Guardian Consent

      1. For students under the age of 18, purchase and use of a WriteBack requires the consent of a parent or legal guardian.

      2. By completing this transaction, the parent/guardian affirms that they understand and accept these Terms & Conditions on behalf of the student.

    1. Consent Overview

    By engaging with WriteBack by Foci Education, you, as a parent or legal guardian, consent to your child (under 18 years of age) using our online academic feedback service.     2. Nature of the Service

    WriteBack is a one-time, submission-based academic feedback service. Students submit written work in English (Literature or Literacy), which is then marked and returned with:

    • Annotated written feedback
      Audio commentary with transcriptions

    • Suggested readings and improvement strategies

    • Return formats including PDF, Word, and Apple Pages files

    3. Data Collection and Use

    By consenting, you acknowledge that:

    • Your child’s academic work and basic personal information (such as name, year level, and contact details) will be collected and stored securely.

    • Your child’s work will be accessed only by authorised Foci Education staff.

    • Excerpts of anonymised student work may be used for internal training or marketing purposes. Identifying details will always be removed.

    4. Limitations of the Service

    • WriteBack is not an ongoing tutoring program. It is a one-off feedback service per submission.

    • Students may not receive further follow-ups beyond a single clarification email. Resubmissions must be purchased separately.

    • It is the responsibility of the student and/or parent to ensure the submitted file is final, complete, and appropriate.

    5. Fees and Refunds

    • The service is fee-based: $220 for Year 7–10 and $250 for Year 11–12.

    • The fee is non-refundable once the submission has been received, regardless of student satisfaction, academic outcome, or content submitted.

    • Errors or incomplete submissions will still be processed and counted as a full use of the service.

    6. Parental Responsibility

    By proceeding with payment and submission, you:

    • Confirm that you are the parent or legal guardian of the student.

    • Acknowledge and accept all policies related to WriteBack, including submission guidelines, data use, pricing, and service limitations.

    • Give consent for Foci Education to communicate directly with your child for the purposes of delivering feedback.

    1. Information We Collect

    When you use WriteBack, we may collect the following types of information:

    Payment Information: Processed securely via third-party payment processors. Foci Education does not store credit card details.

    2. How We Use Your Information

    We use your data to:

    • Provide feedback, annotations, and educational support as part of the WriteBack service.

    • Communicate with you regarding submissions, queries, and service updates.

    • Improve our educational services and resources.

    • Send promotional content (only if you opt in).

    3. Data Storage and Security

    • All personal and academic data is stored securely using encrypted systems.

    • Files are only accessible by authorized Foci Education staff and tutors.

    • We retain marked work for a limited time (up to 90 days) for quality control, after which it is securely deleted.

    4. Sharing Your Information

    We do not sell, rent, or disclose your personal information to third parties, except:

    • When required by law.

    • If necessary to protect the safety, rights, or property of Foci Education or others.

    • For internal marketing purposes, we may use anonymised excerpts of student work (with names and personal details removed).

    5. Children and Parental Consent

    Students under the age of 18 must have the permission of a parent or guardian to use the WriteBack service. By submitting work, you confirm that appropriate parental consent has been obtained.

    6. Your Rights

    You may request to:

    • Access the data we hold about you.

    • Correct any inaccurate information.

    • Withdraw consent or request data deletion (subject to service limitations).

    7. Policy Updates

    We may update this policy from time to time. All updates will be posted on this page with the revised effective date.

  • The first twenty-five (25) new customers to purchase the WriteBack service will receive a fifteen percent (15%) discount off the standard WriteBack pricing as follows:

    • Years 7–10: Regular price $\$$220 AUD, discounted price $\$$187 AUD

    • Years 11–12: Regular price $\$$250 AUD, discounted price $\$$212.50 AUD

    Time-Limited:

    This Promo will commence on the official launch date of the WriteBack service and will remain valid for a period of fourteen (14) calendar days thereafter, or until twenty-five (25) new customer purchases of the WriteBack service have been made, whichever occurs first.

    Eligibility:

    • This Promo is strictly limited to new customers of Foci Education. For the purposes of this Promo, a "new customer" is defined as an individual or entity that has never previously purchased any tuition or WriteBack services from Foci Education.

    • Only one (1) discounted WriteBack transaction is permitted per student under this Promo.

    • This discount cannot be combined with any other offer, tuition credit, or promotional pricing offered by Foci Education.

    Redemption Process:

    • For eligible customers, the discounted price will be automatically applied at the checkout or adjusted manually on the invoice.

    • Customers who attempt to purchase the WriteBack service after the first twenty-five (25) new customer purchases have been completed or after the fourteen (14) calendar day promotional period has expired will be charged the standard WriteBack pricing.

    Non-Refundable:

    Purchases made under this Promo are non-refundable, consistent with the standard WriteBack service policy. Students participating in this Promo remain subject to all submission requirements outlined in the general WriteBack Terms and Conditions.

    Service Scope and Deadlines:

    All other WriteBack service policies, including but not limited to submission guidelines, turnaround times, feedback formats, and follow-up procedures, remain unchanged and fully applicable to both discounted and full-price customers.

    Changes to Offer:

    Foci Education reserves the right to amend or withdraw this Promo at any time without prior notice. However, any such amendment or withdrawal will not affect purchases that have already been completed by eligible customers under the terms of this Promo prior to the date of the amendment or withdrawal.

  • Foci Education is launching a one-time mark up service called ‘WriteBack’ where students can submit a written English piece (up to 1100 words) for detailed feedback, without committing to ongoing tuition. This standalone service is priced at $250.

    As part of our “First Mark, Full Credit” promotion, new customers who purchase the WriteBack will receive the entire amount back as a redeemable credit for future term-based tuition services at Foci. This credit:

    • Can only be applied towards the next full academic term (not the current one),

    • Cannot be combined with family or multi-child discounts, and

    • Must be used in accordance with Foci’s standard tuition terms and policies.

    The promotion is designed to allow students and families to experience Foci’s quality teaching and feedback, while encouraging a seamless pathway into term-based tuition, which offers greater value and continuity of learning

    Terms & Conditions: WriteBack – Credit Redemption Policy

    1. Eligibility for Credit Redemption

      1. Customers who purchase a their first WriteBack are entitled to receive the full amount as a tuition credit to be used exclusively at Foci Education.

      2. The tuition credit is non-transferable and applies only to future term enrolments. It cannot be applied to the current term of study in which the WriteBack was purchased.

    2. Timing of Credit Activation

      1. The $250 tuition credit becomes active and redeemable from the following full academic term after the purchase date.

      2. This ensures the credit is applied to a complete term’s tuition package and not retroactively or in partial/incomplete terms.

    3. Restriction on Offset Against Missed Lessons

      1. Foci Education has a separate policy that provides refunds or credit for missed lessons.

      2. To maintain fairness and the integrity of this policy, the $250 tuition credit from the WriteBack cannot be used to reduce the value of invoices containing refunded or credited missed lessons.

      3. This means that if a student has missed lessons in a given term and receives credit or refunds for those, the $250 cannot be applied toward that same term’s invoice.

    4. Credit Expiry

      1. The $250 tuition credit must be used within two academic terms from the date of purchase. Unused credits after this period will expire and are not eligible for refund.

    5. No Cash Value

      1. The $250 credit holds no cash value and cannot be redeemed for money or used outside of Foci Education’s tuition services.

    6. One-Time Use

      1. The tuition credit from the WriteBack is applicable once per student and only on their first purchase of the WriteBack. Repeat purchases of the WriteBack do not qualify for additional tuition credit unless otherwise specified in writing by Foci Education.
